CONSENT CALENDAR

All matters listed under the Consent Calendar are considered to be routine in nature and will be approved by one blanket motion with a roll call vote.

There will be no separate discussion of these items unless persons request specific items to be removed from the Consent Calendar for discussion and separate action. Any items removed will be considered after the motion to approve the Consent Calendar.

  1. Request for Services of the Placer County Clerk for General Municipal Elections   Pages 13-16

    By RESOLUTION approve the request of the City Clerk of the City of Auburn to utilize the services of the Placer County Clerk for the General Municipal Election of November 2, 2010.

  2. Weed Abatement – Declare Public Nuisance   Pages 17-30

    By RESOLUTION declare Public Nuisance of certain properties within the City of Auburn identified as containing weeds, rubbish, and or debris.

    By RESOLUTION declare as surplus to the City’s needs the equipment listed on Exhibit A and direct staff to contract with an auctioneer to assist the City in disposal of equipment or properly dispose of items.

    By RESOLUTION allow the public safety vehicles for the City of Auburn to display a sticker that supports organ donors.

    By RESOLUTION authorize the City Manager or his designee to approve the assignment and assumption of the Auburn Airport Fuel System Operator Agreement between the City of Auburn, Gold Country Aviation and Threshold Technologies, Inc.


  10. CalPERS Contract Amendment Ordinance – 1959 Survivor Death Benefit Program  Pages 95-100

    By URGENCY ORDINANCE approve an amendment to the contract between the City of Auburn and CalPERS, providing Section 21754 (Fourth Level of Survivor Death Benefits) for local fire members. Additional to introduce a NON-URGENCY ORDINANCE approving the same amendment to repeal the urgency ordinance when effective.

  14. 2009 Weed Abatement Program, Assess Tax Roles  Pages 101-108

  15. I. By MOTION conduct a Public Hearing to allow for objections from any property owner liable to be assessed for weed abatement costs during 2009.

    II. By RESOLUTION approve the 2009 cost report of the weed abatement program and direct the City Clerk to file a certified copy of the report with the Placer County Auditor-Controller in order to collect cost assessments.


  16. Public Hearing to consider Levying of Assessments for Fiscal Year 2010-11 in connection with the Old Town Business Improvement District and the Downtown Auburn Business Improvement District  Pages 109-112

  17. I. By MOTION conduct a Public Hearing

    II. By RESOLUTION adopt the 2010-11 Levying of Assessments in connection with the Old Town Auburn Business Improvement District and the Downtown Auburn Business Improvement District.


  18. Rule 20B – Underground Utility District 2010A  Pages 113-120

  19. I. By MOTION hold a Public Hearing regarding the formation of the Underground Utility District 2010A.

    II. By RESOLUTION adesignate the City of Auburn Underground Utility District 2010A along Lincoln Way as shown on Exhibit A.


  20. Second Reading of an Ordinance Amending Chapter 97 of the Auburn Municipal Code Relating to Animals, including Specific Provisions for the Spay, Neuter and Breeding of Pit Bull Dogs.   Pages 121-254

  21. Staff recommends that the City Council take the following actions:

    A. Hold a Second Reading, by title only, of an Ordinance Amending Chapter 97 of the Auburn Municipal Code Relating to Animals, Including Specific Provisions for the Spay, Neuter and Breeding of Pit Bull Dogs; and,

    B. Adopt a Resolution establishing city policy to request, during sentencing of individuals convicted of violent crimes or drugs, that the District Attorney’s Office seek conditions of probation and/or parole prohibiting those persons from owning dogs over 20 pounds in size.

    Alternative Recommendation

    A1. Amend the Ordinance and Introduce and hold a first reading, by title only, of the Animal Regulations Ordinance deleting breed specific spay, neuter and breeding requirements for pit bull dogs; or,

    A2. Amend the Ordinance and Introduce and hold a first reading, by title only, of the Animal Regulations Ordinance requiring, with certain exception, all dogs to be spayed or neutered.

    The purpose of these reports is to provide information to the city council and public on projects and programs that are discussed at committee meetings. No decisions are to be made on these issues. If a council member would like formal action on any of these discussed items, it will be placed on a future city council agenda.

    By MOTION support the nomination of city owned buildings for listing on the National Register of Historic Places. If the Council decides to support the nomination, Council Member Holmes has drafted a proposed letter (Exhibit A).

    OR

    By MOTION do not support the nomination of city owned buildings for listing on the National Register of Historic Places. Staff will send a letter of notification to the California State Office of Historical Preservation.
